Noise in apartment buildings is one of the most common conflicts between neighbors in Albania. Loud music, renovation work at inappropriate hours, late-night parties, or constant movement can become a serious issue for everyday life.

But what can citizens do in these situations, and what does Albanian law provide?

First: Try to Resolve It Peacefully

In most cases, calm communication with the neighbor is the most effective solution. Often, the person is not aware that they are disturbing other residents.

If the problem continues, it is recommended to:

  • notify the building administrator;

  • request intervention from the residents’ community;

  • keep records of the dates and times when the noise occurs.

This information may later serve as evidence in administrative or legal procedures.

What Is Considered Disturbing Noise?

Albanian legislation on environmental noise defines the following time periods:

  • daytime: 06:00 – 19:00

  • evening: 19:00 – 23:00

  • nighttime: 23:00 – 06:00

Noise during nighttime hours is considered more problematic, and individuals or businesses exceeding permitted limits may face administrative or criminal measures.

When Can You Call the Police?

If the noise is continuous, intense, or occurs during the night, citizens have the right to contact the State Police.

According to the Albanian Criminal Code, “disturbance of public peace” is considered a criminal offense when disturbing noise significantly affects the peace and normal living conditions of citizens.

In practice, the police may:

  • warn the individual or business;

  • impose fines;

  • refer the case for further administrative or criminal procedures.

For businesses or venues exceeding legal noise limits, the law provides significant fines and, in repeated cases, suspension of activity.

What If the Noise Comes from Renovation Work?

Renovation work in apartments is another common source of conflict. Although Albanian law does not always define a single nationwide schedule for private renovation work, municipalities, building administrations, or community regulations may establish certain restrictions.

In general, it is considered acceptable practice to:

  • avoid construction work during nighttime;

  • respect rest hours;

  • inform neighbors in advance about intensive work.

Proper communication often helps avoid conflicts and tensions between residents.

Can the Case Be Taken to Court?

Yes. In serious and ongoing cases, citizens may pursue civil legal action for disturbance of peace and interference with the normal use of property.

The Albanian Civil Code protects every person’s right to peacefully enjoy their property and living conditions, while courts may order the cessation of behavior causing continuous disturbance.

In certain cases, compensation for damages may also be requested.

Practical Recommendations

Legal experts recommend:

  • maintaining respectful initial communication with neighbors;

  • documenting incidents with video, audio, or witnesses;

  • avoiding direct conflicts;

  • involving the building administrator;

  • contacting the police in repeated cases.

Peace and quiet in one’s home are not only ethical matters or signs of respect toward neighbors, but also rights protected by Albanian law. Understanding your rights and following the proper steps can help resolve conflicts without escalation and ensure a more peaceful living environment for everyone.
